Terms of Service & Participation Agreement

Welcome to Develop The Player. These Terms of Service and Participation Agreement (the “Terms”) are an agreement between you and Develop The Player, LLC (“Develop The Player”, “we”, “us”). They cover your use of our website and player dashboards and your family’s participation in our coaching and player-development lessons. By creating an account, booking a lesson, or using the site, you agree to these Terms on behalf of yourself and any minor athlete you register.

1. Who may use Develop The Player

You must be at least 18 and the parent or legal guardian of the player(s) you register. You are responsible for your account and for the activity of your players on it. If you are registering a child, you represent that you have the legal authority to agree to these Terms and to authorize their participation.

2. What we provide

Develop The Player offers (a) in-person baseball lessons and player development with our coaches, and (b) a website with player dashboards, training content, videos, progress metrics, and scheduling tools. Lessons are provided by the individual coach you book with. Availability, pricing, locations, and content may change.

3. Participation acknowledgment

You acknowledge that participation in baseball instruction and athletic training involves inherent risks, including the risk of injury. By participating, you voluntarily assume those risks on behalf of yourself and your player(s). You understand that no training program or instruction can eliminate all risks associated with athletic participation.

4. Accounts & player information

Keep your login details secure and your contact information accurate. You control the players on your account and may add or remove them. We handle your and your players’ information as described in our Privacy Policy. Player dashboards are visible to you, your player (via their login), and our coaching staff.

5. Booking, payments & cancellations

When you request a lesson, the time is held while the coach reviews it; the lesson is confirmed only when the coach approves it. Lesson fees are set by and paid to your coach — by card or Cash App Pay online (where the coach has enabled it), or directly by Venmo, Cash App, Zelle, or cash. Develop The Player does not add a fee to lesson payments. Cancellations made less than 24 hours before the lesson are 50% non-refundable (you'll be refunded 50%). Cancel 24+ hours ahead for a full refund. If a coach cancels, you're always refunded in full.

6. Email communications

We'll email you about your account and lessons (confirmations, reminders, and occasional updates). You can unsubscribe from non-essential emails at any time. Transactional emails needed to run your account and lessons (such as confirmations and reminders) are part of the service.

7. Text message (SMS) communications

By checking this box you agree to receive automated text messages from Develop The Player about lessons — requests, confirmations, reminders, and account notices — at the mobile number you provide. Consent is not a condition of any purchase. Message frequency varies. Message and data rates may apply. Reply STOP to cancel or HELP for help. You can also manage text messages any time in your account settings. Carriers are not liable for delayed or undelivered messages. See our Privacy Policy for how we handle your mobile information — we do not sell it, and we do not share it with third parties for their own marketing.

8. Acceptable use

Use the site and services only for their intended, lawful purpose. Don’t misuse other families’ information, attempt to access accounts that aren’t yours, or interfere with the site’s operation.

9. Changes, suspension & termination

We may update these Terms; when we do, we’ll update the version above and ask you to re-accept the current version on your next visit. You may close your account at any time by contacting us. We may suspend or end access for conduct that violates these Terms.

10. Assumption of Risk and Limitation of Liability

Participation in baseball instruction, conditioning, throwing, hitting, strength training, agility training, and related athletic activities involves inherent risks, including the risk of serious injury, permanent disability, or death. By participating, you voluntarily assume all ordinary risks associated with these activities on behalf of yourself and the player(s) you register.

To the fullest extent permitted by applicable law, Develop The Player, LLC, its owners, coaches, employees, contractors, affiliates, and agents shall not be liable for injuries, losses, damages, or claims arising from the ordinary risks of participation in athletic activities or from ordinary negligence.

You understand and agree that you are solely responsible for obtaining and maintaining appropriate medical and health insurance for your player(s) and for all medical expenses arising from participation.

Nothing in these Terms is intended to waive liability that cannot legally be waived under applicable law, including liability arising from gross negligence, reckless conduct, or intentional misconduct.

11. Governing law

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules.
